What can be patented?
A country will grant a patent for an invention that is novel and inventive. Generally speaking, novelty and inventive step are judged against publications and uses of the invention before the patent is filed. An invention is novel if it is not exactly the same as what is disclosed in the earlier publications or uses. An invention has inventive step if the difference between the invention and what was published or used is not an obvious difference.
The earlier publication or use can occur anywhere in the world, and includes your own publications or uses made before you apply for a patent. This is why it is critical to seek the advice of an intellectual property specialist and apply for a patent before you show or use the invention.
